Ken, Doug and Other Inspirational Mediators

I just returned from San Diego, where I spent most of last week at the annual convention of the Association for Dispute Resolution (ACR), a leading international group of arbitrators, mediators (commercial, family, community, etc), and peacemakers of all stripes. During the convention, I attended the Advanced Commercial Mediation Institute (ACMI), which was co-chaired by Jerome Allan Landau and Lee Jay Berman, two nationally renowned mediators who've inspired me for a long time, although I'll…See More

Welcome to the Rest of My Life

As I enter September, I feel as though a series of enormous weights has finally been lifted from my back; I hope that I've come to the end of my annus horribilus. My sorry tale began in late January of this year when I developed my customary winter cough. I say customary, since, being asthmatic, I seem to contract a bone shaking cough almost every winter. Past experience had taught me that my doctor would, at best, give me an antibiotic, and, in truth, the cough would just run its course. Well,…See More

Bob Tessier commented on Alec Wisner's blog post Why I Mediate
"Thanks Alec for sharing a very profound and personal story. Although unique in its details, I think that people find their way to mediation as a career at least in part through intense personal struggles, or at the very least, to satisfy a deep…"

Why I Mediate

{the First in an occasional series of articles)Since I began my mediation career just seven years ago, the question that I have heard, almost continuously, from professional friends and acquaintances, personal friends, and from relatives, has been: "Alec, why in the world are you mediating?" There's always a follow-up statement, although this varies with the questioner. Some of the follow ups include:"But I thought you were so enthusiastic about your law practice.""But everything else you ever…See More

"Excellent perspective, Bob. Another problem, of course, is setting the table so that you overcome the problem of one party thinking that the apology is merely a quid pro quo. That's the most obvious reaction to the suggestion, isn't it?"

Bob Tessier commented on Alec Wisner's blog post Guest Blogger - Learn to Exercise Forgivness for Inner Strength

Uncertainty Drives Conflict Resolution

After many years of mediating litigated cases, I find that several threads continually recur. Among the most pervasive are the following:

· Attorneys believe that their analysis of the case is superior to that of their opponent

· Parties believe that the opposing party is insincere in his/her/its position

· Attorneys believe that the opposing witnesses will be surprised by certain evidence when directly confronted by it at trial

· Attorneys believe that they will be… Continue

Mediating Commercial and Litigated Cases with Lee Jay Berman at American Institute of Mediation

May 16, 2017 to May 20, 2017
This program is a practical training course. While covering theory to give you a framework and the intellectual understanding of negotiation and mediation, this course is about learning. Our focus is on your doing, practicing and experimenting with negotiating and mediating. There is much to teach about mediation and negotiation, but one reason mediators fail is because they understand the theory, but cannot execute it when under the gun. In this course, you will mediate and negotiate your way…See More

Grow Your Mediation Practice Now! with Lee Jay Berman at American Institute of Mediation

January 28, 2017 from 9am to 4pm
We volunteer and we gripe.  We go to “networking” events, and don’t feel comfortable there or don’t know what to do.  Many of those trying to establish a career in mediation come from prior careers in law, mental health or education.  These three careers are among the weakest at marketing and self-promotion.  Our industry suffers unnecessarily because so many are highly skilled at mediating, and yet lack the skills that enable them to secure the opportunity to actually mediate.  In this course,…See More
