Mediation Marketing Minute Vol. 15

So it's been a rough week or two, and I've been pondering what makes your customers keep wanting to come back. Of course, results are a big plus. When I had a recent streak of 19 in a row with settlements, I would have thought that results were all you needed...

Moving the Goalposts - How To Craft a Mediator's Proposal

Being “Authentic” as a mediator-what do you think?

As each of you know, in mediation, when we listen, people talk. Talking about what really matters to them so they can reach their own solutions. During this process, while being authentic, I have caught myself slightly full of emotions for the parties and often wondered if this was defying the neutral classification that we as mediators must carry out?

Exhilaration and Disappointment

Original Intent v Consistency, and the Constitutional right to privacy

For many years, I've been a bit upset about the "original intent" faction of the bar, and, more specifically, the progeny of the Federalist Society, who, as a result of 5 out of 7 of the most recent Presidential terms worth of conservative Republican court nominations, have come to dominate the Federal judiciary. A settlement is meaningless if it the parties don't respect it. Parties who don't respect settlements simply see breach as another cost of doing business, accepting further litigation if they see the overall result to be profitable.
